    Really can't believe their are people on this board supporting HOA's position, but oh well. The spirit of the law obviously wasn't meant to be interpreted as some of you think it is.

    It's your money, you can waste it on a lawyer if you want to.

    I am not supporting either position, I'm just pointing out that you seem to be "interpreting" the "spirit" of the law to say some other than what it clearly states.

    If they had meant the law to apply to anywhere on the property rather than just on the building, why include any text that even mentions buildings?
    Simply leaving the word "building" out would have made the language much simpler and wouldn't have required multiple paragraphs explaining how the law applies to "buildings" and/or "roofs"

    By that logic all clothes lines would have to be attached to the building, which is not the case.

    Figures.  My HOA denied my solar pergolas in March 2020.  I built the pergolas and had solar installed anyways.  The solar pergolas were unnoticeable until a storm blow my privacy gates opened in June 2021 at the same time of a community inspection, now I'm going through the same problems with my HOA. 

    I'm not getting many call backs from lawyers interested in fighting this.  Anyone know a good lawyer?

    Many times, HOA boards attract lawyers as homeowners, or in some cases, the original builder still has ownership in the development and has their lawyers involved.

    And there seem to be law firms that HOA's just farm their management to... And those law firms can be sharks.

    I am so sorry you are having to go through this now. Watch out--The HOA's (at least in California) can put liens on your property for fines/fees/etc. at the drop of a hat. Be careful that you don't end up with huge fees/fines/etc. Even if you are correct in law.
